Now vs if chaptered

Now: no standalone first-degree stolen/defaced-gun-on-officer count; defacing is third degree. If chaptered: new non-merge 1st/2nd-degree 2C:12 counts plus degree upgrades on 2C:39-3(e). Confirm chaptering before advising.

Defender utility

New Jersey defenders: do not charge or plead a 'MarcAnthony' first/second-degree count unless this bill or the Assembly twin chapters and is in effect on the offense date. If it chapters, the non-merge first-degree SBI-on-officer count is the exposure issue; still demand proof the firearm was stolen or actually defaced and that the injured person was a law-enforcement officer. Current defacing remains third degree until chaptered.

Who this is for. NJ PDs on defaced/stolen-firearm and officer-injury calendars — pending new non-merge degrees, not present law; not a California charge.

Penalties (if chaptered)

If chaptered: new 2C:12 first degree (10–20 years) for SBI to an officer with a stolen/defaced firearm; second degree (5–10) for bodily injury; non-merge. Defacing a firearm becomes second degree; buying/receiving a defaced firearm becomes third degree.
