Now vs if chaptered

Now: immediate-family transfers are exempt from the licensed-dealer conduit. If chaptered: family transfers must go through an FFL; a kitchen-table hand-off can be pled as 2C:58-3. Confirm chaptering before advising.

Defender utility

New Jersey defenders: a family hand-off is not a dealer-bypass crime today. If this chapters, an intra-family transfer without an FFL becomes the existing 2C:58-3 unlicensed-transfer theory — demand proof of a 'transfer' and that the parties are not in a remaining exemption (LE, C&R, temporary). User-duty / private-transfer vehicle; not a current charge.

Who this is for. NJ PDs on private-transfer / family-hand-off calendars — pending FFL-conduit expansion, not present law; not a California charge.
